This paper argues that the approach to questions of authority, legitimacy, and personal identity characteristic of contemporary European law presents a paradox. The power of the legal project that emerged after the French Revolution lay in its deployment of the notion of abstract legal subjectivity to challenge claimed authority. Much is made of the public law dimensions of this revolutionary moment—the creation of political constitutions establishing national citizenship and human rights standards. But the transposition of abstract legal subjectivity into the (...) private law through national social constitutions like Civil Codes has been far less successful.legal subjectivity in public law regimes necessarily privileges some personal identities over others in its construction of citizenship. These privileged identities of public law citizenship limit how legal subjects can express their identities in the private law. The paper proposes an alternative, pluralist, theorization of the diverse, iterative character of everyday human interaction that gives content to the idea of legal subjectivity in the private law. It seeks to reconcile a public law of abstract, unitary citizenship with a private law of plural legal subjectivities in a manner that advances the project of democratic constitutionalism. (shrink)

This article discusses the process of empirical research on access to justice, explaining the procedure from data collection to analysis. Research into access to justice finds ways to render civil justice to citizens equitably. Reliable, non-anecdotal data is a prerequisite for useful empirical research into access to justice. Three international initiatives illustrate the reflection of access to justice in research projects. They are, the World Bank's Justice for the Poor Program, UNDP Commission on Legal Empowerment of the Poor, and the (...) Tilburg Microjustice Initiative. The most comprehensive empirical projects on access to justice are those sponsored at the national or sub-national level. Non-governmental drivers of broad-based data collection are other legal actors. This article discusses examples of data collection and evaluation in countries where research has generated data on civil justice. Finally, this article discusses barriers to access to justice, which cause exclusion. (shrink)

Classical archaeology in the service of the state and national identity is not a new concept, although it is one that is seen less, or at least less blatantly, in modern Europe. This particular use of the classical past is still very much in use in the region of Macedonia, both the Greek province and the Former Yugoslav Republic of Macedonia. Nationalism uses archaeology and the imagery of the ancient world to claim legitimacy in the modern world. By claiming the (...) ancient past and projecting it into the present, nations can create a strong national identity. By tying the present day inhabitants of an area to a strong cultural past, the nation itself becomes more legitimate. Problems arise when two nations seek to claim the same past as in the case in the Greek province of Macedonia and the Former Yugoslav Republic of Macedonia. This competition and issues surrounding the claim of ownership of a particular national past can be seen through the examples of the tumulus at Vergina and the differing traditions of the symposion in Macedonia and Athens. The projection of the past into the present can be seen in the Former Yugoslav Republic of Macedonia flag, in three pamphlets on the “Macedonian Question” from Greece, and in the recent rebuilding of Former Yugoslav Republic of Macedonia’s capital, Skopje. SUMMARYAs one of his first acts upon becoming Astronomer Royal in 1835, George Airy made moves to set up a new observatory at Greenwich to study the Earth’s magnetic field. This paper uses Airy’s correspondence to argue that, while members of the reform movement in British science were putting pressure on the Royal Observatory to branch out into geomagnetism and meteorology, Airy established the magnetic observatory on his own initiative, ahead of Alexander von Humboldt’s request for British participation in (...) the worldwide magnetic charting project that later became known as the ‘Magnetic Crusade’. That the Greenwich magnetic observatory did not become operational until 1839 was due to a series of incidental factors that provide a case study in the technical and political obstacles to be overcome in building a new government observatory. Airy attached less importance to meteorology than he did to geomagnetism. In 1840, he set up a full programme of meteorological observations at Greenwich – and thus turned his magnetic observatory into the ‘Magnetic and Meteorological department’ – only as the price of foiling an attempt by Edward Sabine and others in the London scientific elite to found a rival magnetic and meteorological observatory. Studying the origins of Airy’s Magnetic and Meteorological department highlights how important the context of other institutions and trends in science is to understanding the development of Britain’s national observatory. In this article, I argue that that the primary goal of statues honouring public figures is to create and shape a collective identity. The way that these statues further the goal of identity is not by holding up the subjects of the statues as admirable but rather by asserting that the subjects were in some way objectively important and central to some group surrounding the statue. I will look at the defences for keeping statues of and awards named after John (...) A. Macdonald and show that the primary concern is not with defending the character of Macdonald but rather that removing him is ‘erasing history’. These defences are not about defending Macdonald as a person but rather defending a conception of the Canadian identity that requires Macdonald play a central role. Against these defences of Macdonald, I show that the ‘objective history’ case for him and other such similar figures fails. In the particular case of Macdonald, it fails because he was actually not that important for Canadian history. In the general case of negative public figures, I provide a short defence of how group identities are not static and not unchangeably rooted in a single historically based articulation. (shrink)

This book examines Bertrand Russell’s complicated relationships to the women around him, and to feminism more generally. The essays in this volume offer scholarly reassessments of these relationships and their import for the history of feminism and of analytic philosophy. Russell is a founder of analytic philosophy. He has also been called a feminist due to his public, decades-long advocacy for women’s rights and equality of the sexes. But his private behavior towards wives and sexual partners, and his apparently dismissive (...) (occasionally public) responses to some women philosophers, raises the question of what sort of feminist (or chauvinist) Russell actually was. Focusing on women in Russell’s circle of acquaintance, including feminist activists and his philosophical interlocutors, this book casts new light on a timeless thinker’s feminism and the women who played critical roles in the making of analytic philosophy. Two sources of possible disagreement in bioethics may be associated with pessimism about what bioethics can achieve. First, pluralism implies that bioethics engages with interlocutors who hold divergent moral beliefs. Pessimists might believe that these disagreements significantly limit the extent to which bioethics can provide normatively robust guidance in relevant areas. Second, the interdisciplinary nature of bioethics suggests that interlocutors may hold divergent views on the nature of bioethics itself—particularly its practicality. Pessimists may suppose that interdisciplinary disagreements could frustrate the (...) goals of bioethics. In this article, I explore how wonder may alleviate the concerns of the first group of pessimists regarding problems associated with pluralism, provided that we are willing to accept some interdisciplinary frustrations. Then, I invite readers of this issue of The Journal of Medicine & Philosophy to test these intuitions by considering the role of wonder in these articles. (shrink)

In this paper we discuss how Causal Decision Theory should be modified to handle a class of problematic cases involving deterministic laws. Causal Decision Theory, as it stands, is problematically biased against your endorsing deterministic propositions (for example it tells you to deny Newtonian physics, regardless of how confident you are of its truth). Our response is that this is not a problem for Causal Decision Theory per se, but arises because of the standard method for assessing the truth of (...) certain counterfactuals. The truth of deterministic laws is `modally fragile' on the standard semantics for counterfactuals: if determinism is true and you were to do otherwise, the laws would be different. We provide two ways of avoiding this problem: 1) supplement the standard semantics for counterfactuals with impossible worlds, or 2) introduce rigid designators into the description of problematic decision situations. We argue that both of these approaches are well-motivated and can be readily incorporated into Lewisian Causal Decision Theory. (shrink)

A new speculative ontology of aesthetics. In Aesthesis and Perceptronium, Alexander Wilson presents a theory of materialist and posthumanist aesthetics founded on an original speculative ontology that addresses the interconnections of experience, cognition, organism, and matter. Entering the active fields of contemporary thought known as the new materialisms and realisms, Wilson argues for a rigorous redefining of the criteria that allow us to discriminate between those materials and objects where aesthesis (perception, cognition) takes place and those where it doesn't. (...) Aesthesis and Perceptronium negotiates between indiscriminately pluralist views that attribute mentation to all things and eliminative views that deny the existence of mentation even in humans. By recasting aesthetic questions within the framework of "epistemaesthetics," which considers cognition and aesthetics as belonging to a single category that can neither be fully disentangled nor fully reduced to either of its terms, Wilson forges a theory of nonhuman experience that avoids this untenable dilemma. Through a novel consideration of the evolutionary origins of cognition and its extension in technological developments, the investigation culminates in a rigorous reevaluation of the status of matter, information, computation, causality, and time in terms of their logical and causal engagement with the activities of human and nonhuman agents. I develop an expressivist account of verbal disagreements as practical disagreements over how to use words rather than factual disagreements over what words actually mean. This account enjoys several advantages over others in the literature: it can be implemented in a neo-Stalnakerian possible worlds framework; it accounts for cases where speakers are undecided on how exactly to interpret an expression; it avoids appeals to fraught notions like subject matter, charitable interpretation, and joint-carving; and it naturally extends to an analysis of (...) metalinguistic negotiations. Nietzsche, the Godfather of Fascism? What can Nietzsche have in common with this murderous ideology? Frequently described as the "radical aristocrat" of the spirit, Nietzsche abhorred mass culture and strove to cultivate an Übermensch endowed with exceptional mental qualities. What can such a thinker have in common with the fascistic manipulation of the masses for chauvinistic goals that crushed the autonomy of the individual? The question that lies at the heart of this collection is how Nietzsche came to acquire the (...) deadly "honor" of being considered the philosopher of the Third Reich and whether such claims had any justification. Does it make any sense to hold him in some way responsible for the horrors of Auschwitz? The editors present a range of views that attempt to do justice to the ambiguity and richness of Nietzsche's thought. First-rate contributions by a variety of distinguished philosophers and historians explore in depth Nietzsche's attitudes toward Jews, Judaism, Christianity, anti-Semitism, and National Socialism. A common objection to the very idea of conceptual engineering is the topic continuity problem: whenever one tries to “reengineer” a concept, one only shifts attention away from one concept to another. Put differently, there is no such thing as conceptual revision: there’s only conceptual replacement. Here, I show that topic continuity is compatible with conceptual replacement. Whether the topic is preserved in an act of conceptual replacement simply depends on what is being replaced (a conceptual tool or a conceptual (...) role) and what the topic under discussion is. Thus, the topic continuity problem only arises from a failure to specify these two things. (shrink)

In the paper, a detailed analysis of some new logical aspects of Cantor’s diagonal proof of the uncountability of continuum is presented. For the first time, strict formal, axiomatic, and algorithmic definitions of the notions of potential and actual infinities are presented. It is shown that the actualization of infinite sets and sequences used in Cantor’s proof is a necessary, but hidden, condition of the proof. The explication of the necessary condition and its factual usage within the framework of Cantor’s (...) proof makes, Cantor’s proof invalid. It’s shown that traditional Cantor’s proof has a second necessary, but hidden as well, condition which is teleological by its nature, i.e., is not mathematical. The explication of the second necessary condition makes Cantor’s statement on the uncountability of continuum unprovable from the point of view of classical logic.One of the most dramatic facts in history of science is connected just with the notion of actual infinity and consists in the following. On the one hand, Aristotle, Berkeley, Locke, Descartes, Spinoza, Gauss, Kant, Cauchy, Kronecker, Hermite, Poincaré, Bair, Borel, Brouwer, Quine, Wittgenstein, Weyl, Luzin, and a lot of other outstanding creators of classical logic and classical mathematics, during millenniums, stated categorically and insistently warned about that the actual infinity is a self-contradictory notion and its usage in mathematics is inadmissible (e.g., according to Poincare, “There is no actual infinity. - Cantorians forgot that and fell into contradictions. Later generations will regard Mengenlehre (set theory) as a disease from which one has recovered”). On the other hand, a lot of outstanding scientists of the XX c.c., such as Hilbert, Church, Turing, Gödel, etc., and modern axiomatic set theory as a whole ignored this (intuitive though) opinion of genii and accepted Cantor’s “transfinite paradise”, based on the actual infinity. In the paper some logical, philosophical, and psychological aspects of this historical “favorable opposition” are analyzed, and the fact that the scientific intuition of genii has won the historical battle against the mytho-’logic’ of Cantor’s transfinite ‘paradise’ is explained and logically justified. What is the highest good actually good for in Kant’s third Critique? While there are well-worked out answers to this question in the literature that focus on the highest good’s practical importance, this paper argues that there is an important function for the highest good that has to do exclusively with contemplation. This important function becomes clear once one notices that coherent [konsequent] thinking, for Kant, was synonymous with "bündiges" thinking, and that both are connected with the highest good in (...) the third Critique’s moral proof for God’s existence. I show that the original meaning of "bündig," which is from the carpentry trade and has been forgotten, illuminates the stakes of the highest good in Kant’s system. For us, as proverbial carpenters of reason, coherence is essential for the intellectual activity of constructing a philosophical worldview in his transcendental idealism. I motivate the reading further by showing how this function can neatly reconstruct Kant’s proof for God’s existence in the third Critique. I conclude by sketching Kant’s reasons for why the project of creating a coherent worldview grounded in the highest good is worth the labor costs. (shrink)

A supplemental document for "Metalinguistic Gradability".

Multiple states are at risk of becoming uninhabitable due to climate change, forcing their populations to flee. While the 1951 Refugee Convention provides the gold standard of international protection, it is only applied to a limited subset of people fleeing their countries, those who suffer persecution, which most people fleeing climate change cannot establish. While many journalists and non-lawyers freely use the term “climate refugees,” governments, and courts, as well as UNHCR and many refugee experts, have excluded most climate refugees (...) from the Convention as a matter of legal interpretation. In our 2015 paper, “Unable to Return in the 1951 Refugee Convention: Stateless Refugees and Climate Change”, we sought to reopen the debate on “climate refugees” by arguing that some climate refugees qualify under the 1951 Convention as it is currently written (even if they are not persecuted): those who are stateless and are unable to return to their country of origin because climate change has rendered it uninhabitable. Our interpretation, however, has been rejected by Goodwin-Gill and McAdam (2021) and by Foster and Lambert (2019), which explicitly responds to our paper. Here, we address and respond to their arguments, and develop a new supplementary one, drawing on the principle of systemic integration, as enshrined in Article 31(3)(c) of the Vienna Convention on the Law of Treaties. Call a term ‘pseudo-singular’ if it is syntactically singular but semantically plural. ‘The pair who wrote Principia’ is a good example, standing as it does for the two individuals, Whitehead and Russell. In this journal (2021), Eric Snyder and Stewart Shapiro launched an attack on the idea, calling it ‘linguistically and logically untenable.’ In this reply we rebut every one of their criticisms.

The theological problems of the ethics of love for one’s neighbour are considered: the impossibility of literal fulfilment of the commandments and doubtfulness of their applicability in public and state life. One of the approaches to solving these problems is based on the principle of reverence for life, proposed by Albert Schweitzer and expressing, in his opinion, the essence of love for one’s neighbour. Subsequently, this principle was borrowed by Karl Barth, who gave it a theological justification. Although Barth’s texts (...) on reverence for life are well known, some fundamental issues are still insufficiently investigated. Why did Barth claim that reverence for life does not fully express the essence of Christian ethics? What is the fundamental difference between the Barth’s and Schweitzer’s approaches to Christian ethics? How was this difference of approaches manifested in the practical recommendations? The article provides a comparative analysis of Barth’s and Schweitzer’s ethics and answers the above questions. (shrink)

This paper commences by making a case for a naturalized approach to knowledge‐first epistemology. On this basis it then goes on to describe and defend a naturalized, functionalist account of group knowledge. It then contrasts this with Jennifer Lackey's (2021) account of the epistemological status of groups.

The present article offers the first systematic scholarly analysis of ConKisses, i.e., a sub-class of conative animal calls (i.e., directives addressed to animals) that draw on speech kisses (i.e., sounds that are made with a kiss-like articulatory mechanism). The author examines the pragma-semantics, phonetics, and morphology of ConKisses in 50 languages within a prototype-driven approach to categorization and concludes the following: ConKisses comply with the features associated with the prototype of a conative animal call and may therefore be regarded as (...) the prototype’s canonical instantiations – in fact, they constitute the most canonical subset within the entire conative-animal-call category and thus a highly extra-systematic one from sentence-grammar’s perspective. The proposed solution to the problem of skepticism regarding the meaning of a linguistic expression is based on the idea of language and speech activity, limited to the act of use. Such a truncated and one-sided version of the analysis of language presents a picture where the only subject capable of understanding the meanings of words is the speech agent himself. Although this approach (...) partially allows us to resolve the skeptical problem, it arises again when we pay attention not to the agent of speech, but to the recipient to whom speech activity is directed. It is increasingly common to conceive of scientific research as something that can be planned, managed, and assessed by applying modern techniques of project management. Expecting research to follow certain standardized procedures to achieve clearly defined goals has a long tradition, in particular, in the natural sciences and has arguably contributed to the acceptance of science as an authoritative force that makes tangible contributions to social progress. For the social sciences, however such a narrow understanding of scientific research causes serious (...) problems. Social science research doesn’t always fit in the logic of project management. Moreover, attempts to adjust research practices to correspond with external, managerial experiences are far more consequential and damaging to the social sciences. This article interrogates the prospects and consequences of project thinking in the social sciences and discusses the likely epistemological consequences. To do so, it will recapitulate the historical and social developments that lead to the adoption of managerial principles in social science research and contrasts them with the philosophical principles that underpinned the scientification of thinking about the social. The works of Mary Wollstonecraft (1759-1797) ranged from the early _Thoughts on the Education of Daughters_ to _The Female Reader_, a selection of texts for girls, and included two novels. But her reputation is founded on _A Vindication of the Rights of Woman_ of 1792. This treatise is the first great document of feminism—and is now accepted as a core text in western tradition. It is not widely known that the germ of Wollstonecraft’s great work came out of an earlier (...) and much shorter vindication—A Vindication of the Rights of Men (1790), written in the context of the issues raised by the French Revolution. Alexander von Aphrodisias (ca. 200 n. Chr.) schrieb nicht nur uber das Buch De anima, sondern auch uber viele naturwissenschaftliche und uber samtliche logische Schriften des Aristoteles. Gegen Ende des 15. Jahrhunderts wiesen die Humanisten auf die Bedeutung der griechischen Ausleger fur das Verstandnis der aristotelischen Logik hin. In diesem Zusammenhang wurden um die Mitte des 16. Jahrhunderts samtliche Kommentare Alexanders zur aristotelischen Logik ins Lateinische ubersetzt. Die vorliegenden Kommentare zur Topik und Sophistik wurden von dem bekannten Ubersetzer Dorotheus (...) ins Lateinische ubertragen. (shrink)

Alexander's views on universals are, it seems, quite important in the history of western philosophy. When Boethius gives in his second commentary on Porphyry's Isagoge his solution to the problem of universals as he conceived it, he claims to be adopting Alexander's approach. If true, this means that the locus classicus for all western medieval thinkers on this topic is really a rendering of Alexander's teaching. Alexander commented Aristotle’s statement in his On the Soul “The universal (...) animal either is nothing at all or is posterior if it exists”, and this commentary has been translated into Arabic several times in the classical period. In this study the anonymous Arabic translations of Alexander’s commentary has been translated into English. (shrink)
